Welcome to Trogography. This website is operated by Trogography LLC, a Wyoming limited liability company. Throughout these Terms of Service, the words “Trogography,” “we,” “us,” and “our” refer to Trogography LLC.

Trogography is a creative home for fine art nature photography, books, digital publications, image galleries, and stories inspired by the natural world. These Terms of Service explain the conditions that apply when you visit our website, browse our content, or purchase products from our online store.

By using this website or placing an order, you agree to these Terms of Service, along with any applicable policies referenced here, including our Privacy Policy and Shipping & Returns Policy. Please review these terms before using the website or completing a purchase.

We may update these Terms of Service as our website, products, or business practices evolve. Changes will be posted on this page with an updated effective date. Your continued use of the website after changes become effective constitutes acceptance of the revised terms, to the extent permitted by applicable law.

Trogography welcomes visitors who wish to explore our photography, books, stories, and other creative work. You may browse our website for personal, noncommercial purposes, provided you use it lawfully and respect the rights of Trogography and others.

To place an order through our online store, you must be at least 18 years old or have reached the age of majority in your jurisdiction. Purchases made on behalf of a minor must be completed by a parent or legal guardian.

You agree to use our website and products only for lawful purposes. You may not interfere with the operation or security of the website, introduce malicious software, attempt unauthorized access, or use our content in ways that infringe upon intellectual property rights.

We reserve the right to restrict or suspend access to our website when necessary to address unlawful activity, security concerns, or violations of these Terms, subject to applicable law.

We strive to provide a welcoming, secure, and reliable experience for everyone who visits Trogography. We reserve the right to decline or cancel orders, restrict access, or discontinue services when reasonably necessary to address suspected fraud, unlawful activity, security concerns, or violations of these Terms, subject to applicable law.

Our website relies on third-party technology and service providers to support functions such as payment processing, order fulfillment, website hosting, and communications. Information necessary to provide these services may be transmitted or processed through secure systems operated by these providers, as described in our Privacy Policy.

All photographs, artwork, written content, books, designs, and other original materials presented on Trogography are protected by applicable intellectual property laws. Except as permitted by law or expressly authorized in writing, you may not reproduce, distribute, sell, license, or commercially exploit our content. Additional details concerning ownership and permitted uses are addressed in the intellectual property provisions of these Terms.

Section headings are provided for convenience and do not alter the meaning or interpretation of these Terms.

We make reasonable efforts to ensure that the information presented on Trogography is accurate, current, and helpful. This includes descriptions of our fine art prints, books, digital publications, pricing, and other products and services.

Because our website contains an evolving collection of photographs, stories, educational content, and product information, some material may become outdated or contain occasional errors or omissions. We reserve the right to correct inaccuracies, update information, or revise website content as needed.

Product availability, pricing, specifications, and other purchasing details may change over time. Any corrections or changes affecting an order already placed will be handled in accordance with our applicable policies and legal obligations.

While we strive to provide reliable information, articles, educational materials, and other general website content are provided for informational purposes and should not be considered professional or specialized advice.

Trogography offers original fine art photography, printed books, digital publications, and other creative products through our online store. We take great care in presenting each product accurately and providing customers with clear information about its features, materials, and availability.

Fine Art Photography

Our fine art photographs are offered in various sizes, finishes, and presentation options, including ChromaLuxe metal prints and available framing selections. Unless otherwise specified, these works are offered as Open Editions with Provenance, accompanied by an artwork label documenting the photograph and its authorship.

We make reasonable efforts to represent each photograph and its materials accurately. However, colors, brightness, and subtle details may appear differently depending on your screen, display settings, and viewing conditions. Minor variations between digital previews and finished physical products are normal.

Books and Digital Publications

Our printed books are physical publications featuring original photography, storytelling, and creative content. Product descriptions provide information about available formats, specifications, and pricing.

Digital publications, including eBooks, are provided electronically in the formats identified on their product pages. Purchasing a digital publication grants you a license for personal, noncommercial use. Copyright and other intellectual property rights remain with their respective owners. Digital files may not be reproduced, redistributed, resold, or shared except as expressly authorized or permitted by law.

Availability and Fulfillment

Product availability, sizes, finishes, pricing, and presentation options may change over time. Some products are produced or prepared after an order is placed, and fulfillment times may vary depending on the item and its production requirements.

Applicable shipping arrangements, delivery estimates, returns, exchanges, and procedures for reporting damaged or incorrect merchandise are described in our Shipping & Returns Policy.

We reserve the right to correct product information, discontinue offerings, or limit quantities when reasonably necessary. Any changes affecting an accepted order will be handled in accordance with applicable law and our published policies.

When placing an order through Trogography, you agree to provide accurate and complete billing, shipping, and contact information. This helps us process your purchase, fulfill your order, and communicate with you if questions or issues arise.

You are responsible for reviewing your order details before completing checkout, including product selections, quantities, shipping addresses, and payment information. If you discover an error after placing an order, please contact us as soon as possible so we can determine whether a correction is possible before processing or production begins.

Payments are processed through third-party payment providers using their applicable security measures and procedures. Trogography does not require customers to provide payment card information directly through email or other unsecured communications.

We reserve the right to review, decline, or cancel orders when reasonably necessary due to suspected fraud, payment issues, product unavailability, inaccurate information, or other legitimate business concerns. If an order is canceled after payment has been collected, any refund due will be issued in accordance with applicable law and our published policies.

If we need to clarify or modify an order, we will make reasonable efforts to contact you using the information provided at checkout.

The original photographs, fine art images, books, written stories, designs, and other creative materials presented on Trogography are protected by applicable copyright and intellectual property laws. All rights are reserved by their respective copyright owners, including Thomas Trogdon and Trogography LLC where applicable.

Visitors are welcome to enjoy our website and view its content for personal, noncommercial purposes. However, the availability of material on this website does not grant permission to reproduce, download for redistribution, modify, publish, sell, license, or otherwise commercially exploit that material without appropriate authorization, except as permitted by law.

Purchasing a fine art print, book, or digital publication transfers ownership of the purchased physical item, where applicable, or grants the digital-use rights expressly described with the product. It does not transfer copyright or other intellectual property rights in the underlying creative work.

The Trogography name, branding, logos, and other identifying materials may not be used in ways that falsely suggest affiliation, sponsorship, or endorsement.

If you are interested in licensing a photograph, reproducing an image, or requesting permission to use our creative work, please contact us through our Contact Us page. We welcome legitimate inquiries and will review requests individually.

Nothing in these Terms restricts uses permitted under applicable copyright law, including fair use.

Trogography may include links to external websites, organizations, educational resources, social media platforms, and other online content that we believe may be useful or interesting to our visitors.

These websites are operated independently of Trogography. While we make an effort to share relevant and reputable resources, we do not control their content, availability, security, or privacy practices. The inclusion of a link does not necessarily indicate an endorsement of the organization, its products, or its services.

When you visit an external website, its own terms, policies, and practices apply. We encourage you to review those policies, particularly before providing personal information or making a purchase.

Trogography is not responsible for the content or operation of independently managed websites, or for transactions conducted directly with third parties, except where responsibility cannot be excluded under applicable law.

We welcome questions, comments, and feedback from visitors to Trogography. When you contact us or submit information through our website, you agree to provide truthful information and communicate in a respectful and lawful manner.

You are responsible for ensuring that any material you submit does not infringe upon the intellectual property, privacy, or other rights of another person. Submissions must not contain malicious software, fraudulent information, unlawful material, or content intended to interfere with the operation of our website.

Information you provide through our contact forms or other communications will be used to respond to your inquiries, provide customer assistance, or fulfill other purposes described in our Privacy Policy.

You retain ownership of any original content you submit. By providing a submission, you grant Trogography permission to use that material only as reasonably necessary to address your communication, provide requested assistance, or carry out the purpose for which it was submitted. We will not publicly reproduce or commercially use your original creative work without appropriate authorization, except as otherwise permitted by law.

We reserve the right to disregard or remove submissions that violate these Terms or applicable law, subject to any legal obligations that may apply.

We make reasonable efforts to ensure that product descriptions, pricing, availability, shipping information, and other details presented on Trogography are accurate. Occasionally, however, errors or omissions may occur.

If we discover an error affecting a product or order, we reserve the right to correct the information and take appropriate steps to resolve the issue. Depending on the circumstances, this may include contacting the customer to clarify the order, offering a correction, or canceling an order that cannot be fulfilled as described.

If an order must be canceled because of an error on our part, we will notify the customer and provide any refund due in accordance with applicable law. We will not substitute a different product, change an agreed purchase price, or impose additional charges without appropriate customer authorization.

Customers who notice an error in their order confirmation or purchase details are encouraged to contact us as soon as possible. We will make reasonable efforts to resolve the issue, although changes may not always be possible once production or fulfillment has begun.

Nothing in this section limits the rights or remedies available to customers under applicable consumer protection laws.

We take pride in the photography, books, and creative products offered through Trogography and make reasonable efforts to provide a reliable website, accurate product information, and a positive purchasing experience.

Website Availability and Content

Our website and its informational content are provided on an as-available basis. Although we work to maintain reliable access and accurate information, we cannot guarantee that the website will always operate without interruption, technical errors, or temporary outages.

We may periodically perform maintenance, update website features, or address technical issues that affect availability.

Products and Customer Rights

We strive to deliver products consistent with their descriptions and the specifications provided at the time of purchase.

Information concerning product characteristics, shipping, returns, exchanges, and procedures for reporting damaged or incorrect merchandise is provided on the relevant product pages and in our Shipping & Returns Policy.

Nothing in these Terms excludes or limits warranties, remedies, or other consumer rights that cannot lawfully be excluded or restricted.

Limitation of Liability

To the extent permitted by applicable law, Trogography is not responsible for indirect, incidental, special, or consequential losses arising solely from interruptions, technical problems, or the inability to access or use our website.

This limitation does not apply where liability cannot lawfully be excluded or limited, including any applicable liability for defective products, personal injury, fraud, intentional misconduct, or violations of consumer protection laws.

Nothing in this section limits our obligation to fulfill accepted orders, provide refunds when legally required, or honor applicable product warranties and other enforceable commitments.

If any provision of these Terms of Service is determined by a court or other authority with appropriate jurisdiction to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect, provided they can operate consistently with applicable law.

These Terms of Service, together with the policies referenced throughout this document and any applicable product-specific terms provided at the time of purchase, establish the agreement between you and Trogography concerning your use of our website and purchases made through our online store.

These Terms replace previous versions of our website’s Terms of Service but do not override any separate written agreement between you and Trogography or commitments applicable to an order already accepted.

If a provision of these Terms conflicts with a specific product description, purchasing condition, or published policy, the provision most directly applicable to the transaction will generally govern, subject to applicable law.

Our failure to enforce a particular provision on one occasion does not necessarily mean that we waive the right to enforce it in the future.

Nothing in these Terms limits rights or protections that cannot lawfully be waived.

These Terms of Service and any disputes arising from their interpretation or application will be governed by the laws of the State of Wyoming, United States, to the extent permitted by applicable law.

Trogography LLC is organized under the laws of Wyoming and conducts its business operations from Illinois.

Nothing in these Terms is intended to exclude or limit consumer protection rights or other legal protections that may apply to customers under the laws of their state or jurisdiction.

Any dispute will be subject to the jurisdiction of a court having appropriate authority under applicable law.
